The meeting was called to order by Chairman Jeff Martinique.

Public Hearing Continued from July 16, 2008 

Conduct a public hearing to consider a preliminary and final plat, 2600 S. 98th Street, Edwardsville, Kansas 

The public hearing was opened by Chairman Jeff Martinique.

There was no formal presentation.

Staff report:

City Planner, Dan Van Petten reported that a Final Plat and a Preliminary Site Plan have been submitted for staff review. Staff recommends continuing the Public Hearing to the September 27, 2008 meeting to allow the applicant time to submit a Preliminary Plat for staff review as required.

Commissioner Tim Sweeten made a motion to continue the public hearing until September 17, 2008. The motion was seconded by Commission Robert Craven.

Motion carried 6-0.

Regular Meeting

Secretary’s Report: June 18, 2008 

Motion to approve the Secretary’s Report was made by Commissioner Gerald Pappert. Commissioner Kelli Curry seconded the motion.

The motion carried 6-0.

New Business Continued from July 16, 2008 

Consider Preliminary and Final Plat for 2600 S. 98th Street 

This item was continued until September 17, 2008.

Old Business

Consider application for “temporary special use”. Applicant: George Anderson, 108 S. 102nd Street

Staff report:

City Planner, Dan Van Petten, recommended the Planning Commission takes note that Anderson and Sons Trucking is an “Existing Non-Conforming Use.” As an Existing Non-Conforming Use, the Anderson and Sons Trucking would have the right, under both Kansas law and City ordinance, to continue operating their business at 108 S. 102nd Street, Edwardsville, Kansas. See Item A attached.

Commissioner Tim Sweeten made a motion to recognize the application by the Andersons of their pre-existing condition prior to the ordinance being in place. Commissioner Gerald Pappert seconded the motion.

Motion carried 6-0.

Consider application for “temporary special use”. Applicant: Perry Parks, 1920 S. 98th Street 

Consider application for “temporary special use”. Applicant: Terry Loftis, 1621 S. 104th Street 

Staff report:

City Planner, Dan Van Petten, proposed a compromise with the applicants to allow an orderly transition over the next time period where they can cease their operation, move their location or they bring the operation into conformance.

A series of benchmarks or performance standards were listed as follows:

1)     A landscaping plan be submitted by the applicant by the next planning commission meeting of September 17, 2008 to be reviewed by city staff.

2)     No fuel storage will be allowed on site.

3)     No on-site or stockpiling of materials on site.

4)     The operations will adopt fixed hours and be limited to weekdays. Operations would be limited to 6am to 6pm, Monday through Friday.

5)     Special Use permits will run concurrently with the business license. To allow for review, if applicants adhere to these performance standards, then the temporary special use permit can be used until January 1, 2010. At that time a renewal of the business license and special temporary use permit would be required.

6)     If the applicant ceased business operations, the property would be restored to a semblance of the pre-business activity condition.

7)     Special Use Permits will not be transferrable.

Michael Webb, City Administrator indicated that staff will provide letters to the applicants explaining the performance standards.

Sandra Parks, 1920 S. 98th Street, Edwardsville KS, was concerned regarding the time frame and wanted to verify when the landscape plan will be reviewed.

It was confirmed that the landscape plans will be reviewed on the October 15, 2008 meeting.

Mrs. Parks requested an explanation of the process for review and approval of the special use permit.

Michael Webb, City Administrator explained that the Planning Commission will make a recommendation to the City Council. The City Council will accept, reject or return the recommendation for further discussion.

Mrs. Parks asked for additional information regarding the Existing Non-Conforming Use.

It was explained that the Existing Non-Conforming Use is a use that predated the present zoning ordinance and has remained basically unchanged since that time.

Mrs. Parks stated that the business is not going to continue to operate.

Michael Webb, City Administrator stated that if the business is not going to continue to operate then it would be more important to focus on restoring the site to a pre-business activity condition.

Mrs. Parks indicated that she would include that information in her submission for the September meeting.

Commissioner Tim Sweeten indicated he would not be at the next meeting, but that he would like to have a work session to continue discussion of the zoning for the city at the following meeting in October.

Commissioner Kelli Curry made a motion to adjourn. Commissioner Woody Berry seconded the motion.

Motion carried 6-0.

The meeting adjourned at 7:35pm.

The next regularly scheduled meeting is September 17, 2008.
