As part of the City's upcoming community clean-up projects, on April 01, 2009. The Edwardsville Police Department will begin issuing courtesy notices to residents who appear to have inoperable or abandoned vehicles on their property. |
The courtesy notice is not a citation and there are no fines or penalties associated with it. It is intended as a reminder of the City's ordinance prohibiting storage of inoperable vehicles on property within city limits. Residents believed to be in violation of the ordinance will have ten (10) courtesy days in which to remove the vehicle from the property.
After initial courtesy days have expired, Officers will follow-up with the resident and if the violation has not been rectified, a formal citation will be issued requiring the resident to comply with the ordinance within 10 days or be subject to formal sanctions.
Property inspections will be conducted by Uniformed Officers from the Police Department and will be done by established Patrol Districts in the following order: District 2; North of K-32 and West of 102nd. District 3; North of K-32 and East of 102nd. District 4; Edwardsville Mobile Home Court. District 1; Old town.
ORDINANCE 788:
Ordinance 788 prohibits any person from maintaining or permitting any inoperable vehicle within the city. An abandoned vehicle is any motor vehicle which is not currently registered or tagged pursuant to K.S.A. 8-126 to 8-149 inclusive, as amended; or parked in violation of the code; or incapable of moving under its own power; or in a junked or wrecked condition.
"Inoperable" means a condition of being junked, wrecked, wholly or partially dismantled, discarded, abandoned or unable to perform the function or purpose for which it was originally constructed; absence of a current license plate upon such vehicle; placement of the vehicle of parts thereof upon jacks, blocks, chains or other supports; or the absence of one or more parts of the vehicle necessary for the lawful operation of the vehicle upon the streets and highways; and not enclosed in a garage or other building.
